Minutes of the meeting of Llangathen Community Council held on Tuesday, 16th September 2014 at The Reading Room, Court Henry.

Present: Cllrs. C.Moses (chair), H. James, M. Wynne, E. Morgan, G. Davies, S. Collins and L. Hughes.

In attendance was the clerk, Mrs M Rees.

14/36 APOLOGIES

Apologies for absence were received from Cllr. M. Williams and County Councillor C. Campbell.

14/37 DECLARATION OF INTEREST

There were no declarations of interest.

14/38 MINUTES

It was proposed by Cllr. C. Moses and seconded by Cllr. L. Hughes that the minutes of the meeting held on 15th July 2014 be accepted as a correct record of proceedings.

14/39 MATTERS ARISING

Min 14/25 (1) STABLE BLOCK IN FIELD NEAR RHYD YR AFON / GLANDDU, BROAD OAK

Councillors were aware that one shelter still remained at the above site but were unsure regarding the caravan.  As the matter was being with dealt with by CCC Enforcement Officer, not further action was deemed necessary at this stage. To review at the next meeting.

Min 14/25 (2) DRYSLWYN SQUARE, DRYSLWYN

The clerk had received an e-mail from Edwina Hart, Welsh Government.  It was noted that a study was currently being undertaken in order to identify collision patterns and this would conclude in September. Also, it was noted that the junction markings were fading and arrangements were being made to rectify this.  The clerk was asked to follow up the situation regarding the study.

Min 14/25 (3) BRIDGE OVER RIVER MYDDYFI, NEAR GLANMYDDYFI, PENTREFELIN

Regarding the Council’s request for advisory signage at the above location, John McEvoy of CCC had contacted the clerk advising that due to insufficient verge width, warning signs to indicate the narrowness of the bridge can not be located. Mr McEvoy had offered to meet on site to explain the situation.  Cllr. E. Morgan offered to contact Mr McEvoy.  

Min 14/25 (4) ROAD CONDITION NEAR GLANDDU, BROAD OAK

Stuart Quick of CCC had e-mailed the clerk and confirmed that areas that require maintenance patching have been identified and are currently being assessed on a priority bases against other roads.  Councillors using this area of road volunteered to monitor the situation and report at the next meeting.

Min 14/25 (5) AGRICULTURAL DEVELOPMENTS, LAN FARM, BROAD OAK

The clerk was asked to contact the CCC Planning Department and request an update on the situation regarding the two planning applications that were refused permission, E/30067 and E/30068.  Also, the clerk to contact Rosie Carmichael of CCC Habitat and Conservation Department again for an up date.

Min 14/25 (6) RIVER LASH, DRYSLWYN SQUARE, DRYSLWYN

The clerk had received a letter from Edwina Hart, Welsh Government regarding the Nant Lash Culvert on A40 trunk road.  The matter was being investigated and the clerk was asked to follow up the matter.

Min 14/25 (7)  OVERHANGING BRANCH – HAFOD NEDDYN / CILWERN, BROAD OAK

Members advised that the overhanging branch has not been removed.    The clerk to follow up the matter with CCC.  Members would check the site before the next meeting.

Min 14/14 (9) ROAD CONDITION NEAR SUNNY BANK, LLANGATHEN

Cllr. G. Davies confirmed that he and Cllr. M. Williams had attended a site meeting with Mr John McEvoy of CCC.  Mr McEvoy had forwarded confirmation of the meeting together with a photograph of the proposed siting of the warning sign.  However, there appears to be some confusion as to where the signs should be sited.  The clerk was asked to contact Mr McEvoy and report at the next meeting.

The clerk was instructed to submit an objection to this application on the grounds of Health & Safety issues regarding access / exit to proposed site.

Further comments to be made regarding environmental issues, RSPCA requirements, vermin potential and economic issues.

14/43 PLANNING PERMISSION

Carmarthenshire County Council advised on the planning decisions on the following:

E / 30224, E / 30225 – Proposed one and a half storey replacement dwelling (to include the demolition of the existing house) at Pigeon House, Llangathen for Mr Dick Nowell – permission granted.

14/44 ANNUAL AUDIT

Notice of conclusion of audit had been received from BDO with no matters arising.  The report was presented to council for inspection.  It was proposed by Cllr. E. Morgan and seconded by Cllr. L. Hughes that the annual return be approved and accepted .

14/45 ANY OTHER BUSINESS

The councils web site was discussed and it was noted that the minutes of meetings were being displayed monthly.  It was mentioned that it would be of interest it local photographs could be added to the site.  Cllr. G. Davies volunteered to enquire in the local shop for suitable material.

14/22 APOLOGIES

14/24 MINUTES

It was proposed by Cllr. M. Wynne and seconded by Cllr. H. James that the minutes of the meeting held on 20th May 2014 be accepted as a correct record of proceedings.

14/25 MATTERS ARISING

Min 14/14 (2) STABLE BLOCK IN FIELD NEAR RHYD YR AFON / GLANDDU, BROAD OAK

CCC Planning Department had advised that the caravan at the above location was currently being dealt with by an Enforcement Officer as was the remaining shelter. To review at the next meeting.

Min 14/14 (3) DRYSLWYN SQUARE, DRYSLWYN

The clerk had received a reply from the South Wales Trunk Road Agent in which Richard Jones advised that the matter had been passed onto the Welsh Government for their consideration.  

A reply from the Welsh Government stated that the roads around Dryslwyn Square were the responsibility of Carmarthenshire County Council.  It was suggested that the Community Council should get in touch with Mr Simon Charles to discuss concerns.  The clerk was asked to forward copies of letters to Mr Charles.

Min 14/14 (4) BRIDGE OVER RIVER MYDDYFI, NEAR GLANMYDDYFI, PENTREFELIN

Regarding the Council’s request for advisory signage at the above location, no further information has been received since CCC advised that the Council’s Bridge Engineer would visit the site in order to carry out an inspection.  The clerk was asked to follow up the matter by writing to CCC.  

Min 14/14 (5) ROAD CONDITION NEAR GLANDDU, BROAD OAK

Members confirmed that no repair work had been carried out at the above section of road.  The clerk was asked to write to CCC once again.

Min 14/14 (6) AGRICULTURAL DEVELOPMENTS, LAN FARM, BROAD OAK

Following the submission of three planning applications, CCC have confirmed that two have been refused and one has been granted.  No details have been received from the CCC Habitat and Conservation Department.  To review next month.

Min 14/14 (7) RIVER LASH, DRYSLWYN SQUARE, DRYSLWYN

Following the clerks letter, advising of the problems of a blocked culvert, to South Wales Trunk Road Agent, they had replied and stated that they were unable to trace the original correspondence that gave the full details of the problem.  The clerk had e-mailed a reply to them.  However, Mr Dean, of the SWTRA, had telephoned Cllr. Hughes in order to arrange a suitable time for work to commence.  To review next meeting.

Min 14/14 (8)  OVERHANGING BRANCH – HAFOD NEDDYN / CILWERN, BROAD OAK

Members advised that the overhanging branch has not been removed.  CCC have confirmed that a survey by the County arborist has taken place and that a dangerous tree letter has been sent to the landowner on which the tree is sited.  The clerk to follow up the matter with CCC.

Min 14/14 (9) ROAD CONDITION NEAR SUNNY BANK, LLANGATHEN

Mr John McEvoy of CCC has written to the clerk and a site meeting has been arranged for Friday, 25th July 2014.  Cllrs. Mark Williams and Gary Davies have agreed to attend. To review next meeting.

Min 14/21 (2) COLLEGE CHAPEL, LLANGATHEN

CCC Planning Department had confirmed to the clerk that planning permission at this location had previously been refused and therefore an investigation by an Enforcement Officer was under way.

The problem regarding pedestrian access to the graveyard is not a planning issue and is something that should have been addressed prior to the sale of property.

Min 14/21 (3) POTHOLES IN ROAD NEAR LOCATIONS – DOLCOED, CWMHARAD, CAEAUNEWYDD, DRYSLWYN

Since reporting the road conditions near the above locations to  CCC, no reply had been received.  The clerk was asked to follow up the matter.

14/30 – COUNTY COUNCILLORS REPORT

Councillor Cefin Campbell had apologised for not being present but a prior engagement had prevented him form attending the meeting.  He did however provide the clerk with information regarding the Welsh Local Government Association which have been commissioned by Carmarthenshire County Council to undertake an independent review of its governance arrangements.  A report should be available in September.

14/31 ANNUAL AUDIT

The clerk had received notification from BDO – external auditors – regarding outstanding points which were required before completion of the audit.  The clerk had forwarded the request to D Morris, internal auditor, for verification.  The outcome was that figures – although correct – were inserted into the wrong section on the form.  This was duly explained to Council and amended accordingly.  The RFO and Chair duly signed the form prior to returning the external auditors.

14/32  ANY OTHER BUSINESS

1.  Since the last meeting, it had been reported that the “Capel Isaac” signpost – near the Cwmcrwth junction, Broad Oak, had been knocked over following a car accident.  The clerk had reported this to CCC and the signpost has since been repaired.

Min 13/47 (2) BUS SHELTER AT BROAD OAK

It was agreed not to pursue this matter further and only to review at a future date should the demand for a new shelter materialize.

It had been observed that some of the shelters at this location had been removed but there remained one structure.  Also, there was now a caravan.  The clerk was asked to advise the CCC Planning Department.

The clerk was requested to contact Stuart Quick of CCC once again.

 

Min 13/36 (9) AGRICULTURAL DEVELOPMENTS, LAN FARM, BROAD OAK.

The clerk had been informed by Kevin Jones, CCC Planning Enforcement Officer, that the applicant would be submitting three retrospective application forms in order to retain buildings erected without permission.  Other buildings had been in existence for over four years and are therefore exempt from enforcement action.  No information had been received from the CCC Habitat and Conservation department.  To review at the next meeting.

The clerk to follow up the request for the clearing of the culvert at this location and request South Wales Trunk Road Agency to advise when work will commence.

14/19 COUNTY COUNCILLORS REPORT

 

County Cllr. Cefin Campbell advised that the Head of CCC had now returned to his post following an investigation by the Gloucester Constabulary who were unable to find any wrong doing as a result of the report given by the Wales Audit Office.

Cllr. Campbell reported that he had been chairing the “Gweithgor Iaith y Sir” and advised that a language policy for Carmarthenshire had been implemented.  A report was available.

 

14/20 GRAHAM NOAKES, PLANNING OFFICER, CCC

 

Graham Noakes had very kindly agreed to attend the meeting in order to address and discuss planning procedures.  He gave an overview of the process and also covered matters such as retrospective planning and enforcement procedures.  Members were appreciative to Mr Noakes for giving his time and felt that the discussions were of interest and help in understanding the planning process.

 

14/21 ANY OTHER BUSINESS

 

1.  It was reported that a number of land owners in the Capel Isaac area had received notices from CCC requesting that trees be cut back in order to clear the highway.  Tim Grant of Cefn Martin had informed Cllr. Cefin Campbell that the work requested at this location had been carried out.

2.  Concerns had been expressed regarding building work being carried out at The College Chapel, Llangathen.  It was reported that access to the cemetery was restricted by the general public who wanted to attend graves.  The clerk was asked to advise CCC Planning Department.

3.  It was reported that the road conditions – severe potholes – near the properties of Dolcoed, Cwmharad and Caeaunewydd were in need of attention.  The clerk to advise CCC.

4.  Some local residents had been making enquiries regarding the possibility of a proposed chicken farm at Glanmyddyfi, Pentrefelin.  The CCC Planning Department had confirmed that the authority had had a pre-application enquiry.

Copies of the accounts were circulated and discussed for the year ended 31st March 2013.  These had been audited by Mr D. G. Morris.  It was proposed by Cllr. G. Davies and seconded by Cllr. L. Hughes that the statement of accounts be accepted as correct.

 

13/06 ANNUAL GOVERNANCE STATEMENT

 

The Annual Governance Statement was read out and discussed by members. It was proposed by Cllr. G. Davies and seconded by Cllr. L. Hughes that it be approved by the council.

 

13/07 APPOINTMENT OF CHAIRMAN

 

Cllr. M. Williams was the appointed vice-chairman and therefore it was agreed by council that he take up the role as chairman.  As outgoing chair, Cllr. G. Davies thanked all Councillors for their support over the previous year and especially thanked County Councillor Cefin Campbell and the Clerk, Mrs M Rees.  Cllr. Davies handed over the role of chairman to Cllr. M. Williams and felt confident that he would fulfil the position in a competent manner.

Cllr. M. Williams thanked Cllr. G. Davies for his commitment over the last year and also thanked his colleagues for nominating him as chairman.

13/08 APPOINTMENT OF VICE CHAIR

 

It was proposed by Cllr. L. Hughes and seconded by Cllr. E. Morgan  that Cllr. C. Moses be appointed as vice-chairman.  Cllr. Moses accepted the post and thanked members.

 

13/09 MEMBERSHIP AFFILIATION

 

It was proposed by Cllr. G. Davies and seconded by Cllr. E. Morgan to continue affiliation to Un Llais Cymru and that the chairman and vice-chairman be the nominated councillors to represent quarterly Area Committee meetings and to receive newsletters, bulletins and meeting notifications etc. Also, it was agreed by council that membership to CTA (Carmarthenshire Tourist Association) be continued as they were hosting the community website.

Min 13/36 (4) DRYSLWYN SQUARE – A40

Following a discussion regarding the safety of motorists at this location, the clerk was asked to write to South Wales Trunk Road Agency at Neath to request the re-instatement of red hatch markings.

 Min 13/36 (5) COMMUNITY WEBSITE

The web site www.llangathen.org.uk has now been established.  Members had looked over the site and were very please with the product.  Minutes of meetings would now be displayed on the site, also contact details of the clerk, councillors names and the name and telephone number of the County councillor.  A brief résumé on the history of Llangathen had been provided by Mr D T Davies.  This would now form part of the home page and the clerk would arrange with Menter Bro Dinefwr for a translation into Welsh.

Min 13/36 (6) BRIDGE OVER RIVER MYDDYFI, NEAR GLANMYDDYFI, PENTREFELIN

The clerk was asked to write to Mr Pilliner of CCC for an update on the situation regarding advisory road width signage at this location.

David Rice Forestry had carried out a survey on the oak trees at the above location.  He had issued a tree Health and Safety report.  An invoice was also attached.

It was reported that the road condition at this location remains far from ideal.  The tarmac on the edges of both sides of the road are cracking and giving way, the ditches are very much lower that the road.  The clerk to contact Stuart Quick of CCC once again.

Min 13/36 (9) AGRICULTURAL DEVELOPMENTS, LAN FARM, BROAD OAK.

Planning Enforcement Officer for CCC., Mr Kevin Jones had advised that a Planning Contravention Notice had been served to the owner.  Evidence in the form of a Certificate of Lawfulness application will be requested and also an application for retrospective planning.  R Carmichael, Habitat and Conservation officer, CCC., has advised that an inspection of the land would take place and where trees and hedges have been removed the owner will be advised of the species of plant material required in order to reinstate the landscape.

13/52 COUNTY COUNCILLORS REPORT

County Cllr. Cefin Campbell provided clarification regarding the “Review of Electoral Arrangements.”  The Communities of Llangathen, Llanfihangel Aberbythych and Llanarthney will now be combined to form a single electoral division.  The name of the electoral division will be Llanfihangel Aberbythych.

Cllr. Campbell also gave a brief report regarding the situation at Carmarthenshire County Council and the account given by the Wales Audit Office regarding two payments allegedly unlawful made to the Head of CCC.   He advised that the matter was now being investigated by the  Gloucester Constabulary. The full council meeting held on 27th February 2014 in the Council Chamber attracted some 2,700 viewers via  webcast.

Carmarthenshire County Council are aiming to cut back on costs by up to  £30 million.

When asked what the situation was regarding the Welsh Governments plans regarding re-organisation, he advised that no definite decisions had been made.

1.  Graham Noakes, Planning Officer, CCC., had contacted the clerk following her invitation for a member of the planning department to attend a council meeting in order to clarify some planning points.  The clerk was requested to arrange for Mr Noakes to attend the next council meeting if this was convenient to him.

2.  It was reported that due to very large vehicles frequenting the road passing Sunny Bank, Llangathen, this was causing the hedge banks to collapse and creating very muddy and slippery conditions for the standard motorist.  The clerk to contact CCC for comments regarding signage at this location.

13/38 PRECEPT REQUIREMENT 2014 / 2015

The precept requirement for 2014 / 2015 was requested by Carmarthenshire County Council.  Details of “Footway Lighting” charges for the financial year had been received and also details of Section 137 Expenditure Limit for 2014/15 – this being £7.20 per elector. Copies of estimated expenditure had been prepared by the clerk for the coming financial year, and circulated amongst members for discussion.

It was resolved that the clerk should receive a salary increase of £200, taking her annual salary to £1600.

After discussing the financial situation, it was resolved that the precept requirement for 2014/15 be £7,000.  This figure being £200 less than the previous financial year.  The clerk and acting chair duly signed the form which will be forwarded to Resources Department, CCC.

County Councillor C Campbell had offered his apologies for being absent and will provide a report at the next meeting.

 

13/43 ANY OTHER BUSINESS

 

1.  Concern had been expressed regarding the poor service received from BT following the recent stormy weather.  Lines had come down during the storms and no repairs had been made in two weeks and a further delay of another week was being quoted by the BT staff.  This meant that householders – especially in the Broad Oak area – were without a telephone/broadband service.  Cllr. G. Davies volunteered to look into the matter and report at the next meeting.

It was resolved that the next meeting of Llangathen Community Council would be held on Tuesday 18th March 2014 at  the Reading Room, Court Henry at 7.30pm.
